Breaking News: Trial date set for Wayne Bent case

TRIAL SCHEDULED FOR MONDAY, OCTOBER 20

(July 24) Beyond90Seconds.com has learned that a trial date for the State of New Mexico’s criminal case against controversial church leader Wayne Bent has been scheduled to begin Monday, October 20, 2008 at 9am at the Union County Courthouse in Clayton, New Mexico.

The jury trial is scheduled to last five days.

This new information is found in a Criminal Scheduling Order filed in Union County District Court at 10:04am today.

On May 20, a grand jury indicted Bent on four counts: two counts of criminal sexual contact of a minor in the second degree, unclothed. And two counts of contributing to the delinquency of a minor.

The next court event in the Bent case is a pre-trial hearing scheduled for August 19 at 2:30pm at the Union County Courthouse.  Beyond90Seconds.com has learned that this hearing had been scheduled for August 12, but was rescheduled this morning due to a scheduling conflict.

According to the Criminal Scheduling Order, the State has until September 1 to present Bent’s attorney with a proposed plea agreement.

Union County Court Deputy Clerk Karen Vieites confirms the jury trial will begin October 20 unless a plea agreement is reached prior to that time.

News reports are just now popping-up on the Web that one of five “mystery feet” that have surfaced in the waters near Vancouver, British Columbia has been matched to a man who was known to be depressed.

Canada’s Globe & Mail goes as far to deliver the headline, Investigators match severed foot to missing man.

CTV’s more conservative headline reads, A possible breakthrough in missing feet mystery.

Be sure to visit the (above) CTV link as a *VIDEO* of tonight’s 6 o’clock CTV news story has just been added, to include exclusive coverage of the footless body that washed-up in nearby Washington State (more on that below).

CTV reports that investigators have made a DNA match between one of the feet and a missing man.  No word on the man’s name yet.  CTV says the name might not be released until next week.

It’s a paragraph near the end of the CTV story (near the bottom of the ol’ inverted pyramid) that, in my opinion, is worth of its own headline:

Meanwhile, CTV news has uncovered what may be another piece of the puzzle of the mystery feet. Today we spoke to a coroner who is dealing with a body with no feet.

That will get your attention.  True to nice television “tease”, CTV advises readers to tune it 6pm.

New Mexico church leader now fasting

(*note: the headline to this story originally used the words “hunger strike” instead of “fasting”. The former headline had been written minutes after Wayne Bent published his post. I had not read Bent’s entire post. While some may debate “hunger strike” vs. “fasting,” I feel fairness calls for the word “fasting” in this story’s headline. Strong City leader Wayne Bent says he is now fasting and will continue to do so until a girl taken by the state from his church’s property is returned to her parents.

Here is an excerpt from Wayne Bent’s post published on his Web site around 4:15pm today:

Today, I began a fast, as I did when I was in the heart of the earth for three days and three nights. I will now abstain from eating until the child Willow is returned with no strings attached, or until God brings the deliverance that I seek from the present evil, or the answer to my inquiry of justice is clearly manifested, or I am gone from this life altogether.

On May 20th, 2008, a New Mexico grand jury indicted Bent on four crimes: Two counts of criminal sexual contact of a minor in the second degree, unclothed. And two counts of contributing to the delinquency of a minor.

New Mexico State Police arrested Bent May 6th.

After an ambulance responded to the Union County jail, Bent was released from custody May 9th. His son, Jeff Bent, posted the $55,000 bond.

Bent’s story has been featured on several American television programs, including Larry King Live and FOX News. But the story first found an audience in a British documentary last December. A re-edited version of that documentary appeared on the National Geographic Channel earlier this year.

In an e-mail received at 4:17pm today, Jeff Bent tells Beyond90Seconds.com:

The court declined an emergency hearing today regarding the conditions Willow is having to endure at the hands of CYFD. The initial ten day hearing was never completed and we are going on six weeks now since she was taken. The new post gives all the details.

According to the affidavit for Travesser’s arrest warrant:

* One girl told officials she and Travesser had lain naked in July 2006 when Travesser allegedly kissed her and touched his chest to hers.
* A few days after that, another girl said she had lain naked with Travesser. The two had allegedly kissed as a husband and wife, and then Travesser allegedly kissed her breasts.
* Then, in April 2007, a third girl said she had lain naked with Travesser, although Travesser was clothed. Travesser then allegedly laid chest to chest with her. She was 12 years old at the time.
* A 16-year-old boy told officials that ten people had received letters from Travesser. Seven of the ten were chosen, but not the boy who talked to officials. He had said that several people told him that the seven had lain naked with Travesser. In the community, he said, people were considered married when they slept together.

This morning at about 8:15 AM, officers from the State Police “Impact Team” served an arrest warrant on my Father, Wayne Bent aka Michael Travesser. He was arrested and taken to the State Police annex in Clayton for questioning. They then booked him into the Clayton city jail. I was told by the agent in charge of the case that the arrest warrant specified charges of three counts of sexual contact with a minor, and three counts of contributing to the delinquency of a minor. The bail was set at half a million dollars.

The State Police asked me to come to the courthouse in Clayton so they could question me. After my interview I, and a couple of other people went over to the State Police annex where Michael was being held. They were just escorting him out. He was in handcuffs, but looked serene and contented.

I expect we will be updating this site soon with a more complete response to these false charges, and the meaning behind these new events.

State Police this morning arrested cult leader Wayne C. Bent, *67, and charged him with three counts of criminal sexual contact of a minor and are now interviewing Bent in Clayton, state Department of Public Safety spokesman Peter Olson told the Journal’s Thomas J. Cole. -Albuquerque Journal

(*Although the Albuquerque Journal reports Bent is 67, a prior record of an Idaho drivers license once held by Bent states he was born May 18, 1941. If true, that would make Bent 66 at this time).

According to an e-mail I have received at 9:21 this morning from a member of The Lord Our Righteousness Church, Wayne Bent (aka Michael Travesser) is now in State custody.

The information comes at the end of the following e-mail received this morning:

Dear Mr. Horner,

I am writing, first of all, to tell you that I appreciate the fairness of your approach to the news about our little community here at Strong City. Yours was a “fair and balanced” that has never been remotely entertained by Fox News, and likely any other mainstream media outlet.

Even with the contact and knowledge I have of the media, I was nevertheless appalled at the blatancy of the outright lies, distortions and misrepresentations propagated by the British filmmakers. If the names, faces and voices were disguised, and there remained only the producer’s description of the events transpiring here (even though I have been a first-hand participant in this community since its inception, and known Michael for nearly thirty years), I would not have recognized the film as having been about us — so thoroughly fabricated was it. The National Geographic’s cut of the documentary was much fairer, however, but even there, as would be expected, they presented their own viewpoint of matters, which naturally carried with it the distortion that comes from those not personally involved.

Also my purpose for writing is to inform you that the police came to our land this morning, shortly after eight o’clock, and arrested Michael. It will be interesting to learn what the charges against him are, since I very well know that no laws have been broken here. I thought, in light of your fair treatment of our case, you should be one of the first to know this, rather than the serpentine organization of the media.

In a development that will no doubt further intensify debate regarding illegal immigration, reports coming out of Los Angeles the past hour maintain that the suspect charged with murdering Jamiel Shaw Jr. may be an illegal immigrant.

19-year-old Pedro Espinoza is charged with the March 2 murder.

KABC-TV is reporting that U.S. Immigration and Customs Enforcement (ICE) has filed an immigration hold against Espinoza. The TV station attributes the information to ICE spokesperson Virginia Kice.

17-year-old Jamiel Shaw Jr. was murdered while his mother served her country in Iraq. Police say the suspect killed the popular student athlete without any provocation. According to the LAPD Web site, charges include a special enhancement because Espinoza was allegedly “an active participant in a criminal street gang and the murder was carried out to further the activities of the criminal street gang.”

The enhanced charge makes this a potential death penalty case.

Espinoza had been released from jail just 28 hours prior to Shaw’s murder. It’s a fact that seems more important than ever now.

For if Espinoza is in the US illegally, should the jail, state or prior arresting agency have realized it? And, if so, what would have been the appropriate course of action?

Lawyers might be lining up to represent the Shaw family now.

In light of today’s development regarding Espinoza’s immigration status, don’t be surprised if this case finally finds the glare of the national media’s spotlight.

Just as friends and family of Jamiel Shaw Jr. are gathering for the teenager’s funeral, reports out of Los Angeles state that an arrest has been made in the case.

Reports out of Los Angles state that suspect Pedro Espinoza, 19, is believed to be a gang member. KABC quotes a source that claims Espinoza was “an active participant in a criminal street gang and the murder was carried out to further the activities of the criminal street gang.”

The state of California must still determine if this is a death penalty case.
